On October 22, 2024, IA Law Firm participated as a lecturer in a seminar led by our colleague, Leila Salijević, attorney at IA Law Firm. The seminar focused on the significance of enacting the Law on Professional Rehabilitation, Training, and Employment of Persons with Disabilities in Brčko District, BiH. Organized by the NGO “Posavina bez mina,” the event brought together civil society, media, and decision-makers to discuss the challenges surrounding the employment of persons with disabilities.
Social Benefit and Suggestions
IA Law Firm recognized the societal value of this issue and contributed expert opinions by presenting concrete proposals for drafting legal regulations. These recommendations were founded on extensive research into international legal standards, as well as the existing regulations in neighboring countries and the entities of Bosnia and Herzegovina.
The firm particularly emphasized that Bosnia and Herzegovina, by ratifying the UN Convention on the Rights of Persons with Disabilities in 2010, has committed to aligning national legislation with the principles of the Convention. Properly drafted regulations, in accordance with international principles, ensure legislative effectiveness and maintain coherence within the legal system.
Impact on Employment in Brčko District BiH
In addition to its significance for improving the legal system in Bosnia and Herzegovina, this law would have a direct impact on enhancing the position of persons with disabilities in the Brčko District. During the seminar, IA Law Firm emphasized that legal regulations must include adequate measures to protect the right to access the labor market and ensure working conditions tailored to the needs of persons with disabilities. Introducing incentives for employers who hire persons with disabilities, as well as benefits for adapting workspaces, would represent a key step towards reducing unemployment in this vulnerable population.
IA Law Firm also pointed out the need for systemic measures for professional rehabilitation, as well as the importance of regular monitoring of the implementation of future regulations. Based on an analysis of positive practices in European Union countries, IA Law Firm recommended the introduction of special training and vocational programs that would facilitate the reintegration of persons with disabilities into the labor market.
Cooperation and Transparency
Leila Salijević, an attorney and lecturer at the seminar, emphasized that through dialogue and the establishment of cooperation with civil society organizations, the transparency of the law-making and implementation process can be further improved. Collaboration between legal professionals, NGOs, and government representatives is crucial for developing legislative solutions that best meet the needs of persons with disabilities and the obligations that Bosnia and Herzegovina has under international agreements.
The conclusions from the seminar lay the foundation for further work on drafting legislation that will encompass comprehensive protection and support for persons with disabilities.
